Terms of Service

1. Acceptance

By creating a Gym Tech account or using the platform, you agree to these Terms of Service. Gym Tech ("GT") is provided by 4040 Labs.

2. Eligibility

You must be at least 18 years old and authorized to bind your gym or fitness business to these terms.

3. Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Acceptable use

You agree not to use GT to send spam, unsolicited marketing, or unlawful messages. You will obtain member consent before adding their contact details to the platform and respect opt-out requests.

5. WhatsApp communications

Use of WhatsApp messaging through GT is subject to WhatsApp Business policies. We may suspend messaging for accounts that violate those policies.

6. Subscription and billing

Paid plans renew automatically unless cancelled. Fees are non-refundable except where required by law.

7. Intellectual property

The GT platform, branding, and code are owned by 4040 Labs. You retain ownership of your business and member data.

8. Disclaimers

GT is provided "as is" without warranty of any kind. We do not guarantee uninterrupted message delivery, which depends on third-party providers.

9. Limitation of liability

To the maximum extent permitted by law, 4040 Labs' total liability under these terms is limited to the fees paid in the 12 months preceding the claim.

10. Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of India.
